1. Acceptance of terms

By accessing or using the LAG Golf website at laggolf.ca (the "Site"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Site. These terms apply to all visitors, prospective customers and anyone else who accesses the Site.

These Terms of Use govern use of the Site only. Separate lease and purchase agreements govern the supply of equipment and services; those documents take precedence over these terms in the event of any conflict.

2. About our services

LAG Golf Inc. ("LAG Golf", "we", "us") provides commercial golf simulator leasing and sales, including equipment supply, professional installation, ongoing maintenance and software support. Information on the Site is provided for general reference and does not constitute a binding offer. All pricing, specifications and availability are subject to confirmation in a formal proposal.

3. Use of the Site

You may use the Site for lawful purposes only. You agree not to:

• Use the Site in any way that violates applicable laws or regulations
• Transmit unsolicited commercial communications
• Attempt to gain unauthorised access to any part of the Site or its underlying systems
• Use automated means to scrape, crawl or harvest content from the Site
• Post or transmit any material that is defamatory, offensive or infringes third-party rights
• Impersonate LAG Golf or any other person or entity

4. Intellectual property

All content on the Site — including text, images, graphics, logos, icons and software — is the property of LAG Golf Inc. or its licensors and is protected by applicable copyright, trade-mark and other intellectual property laws.

You may view, print and download content from the Site for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from or commercially exploit any Site content without our prior written consent.

The LAG Golf name and logo are trade-marks of LAG Golf Inc. Other product names and marks referenced on the Site (including Foresight Sports) are the property of their respective owners.

5. Quote requests and inquiries

Submitting a quote request through the Site does not create a binding contract. A binding agreement arises only when both parties have executed a written lease or purchase agreement. We reserve the right to decline any inquiry at our discretion.

Information you submit in a quote request will be used to prepare a proposal and may be retained in accordance with our Privacy Policy.

6. Accuracy of information

We endeavour to keep Site content accurate and up to date but make no warranty that it is complete, current or error-free. Prices, product specifications and availability displayed on the Site are subject to change without notice and must be confirmed in a written proposal.

7. Third-party links

The Site may contain links to third-party websites. These links are provided for convenience only. We do not endorse, control or assume responsibility for the content or practices of any linked site. Accessing third-party sites is at your own risk.

8. Disclaimer of warranties

The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of viruses or other harmful components.

9. Limitation of liability

To the maximum extent permitted by applicable law, LAG Golf Inc. and its directors, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to your use of the Site, even if advised of the possibility of such damages. Our total liability to you for any claim arising from use of the Site shall not exceed one hundred Canadian dollars (CAD $100).

10. Indemnification

You agree to indemnify and hold harmless LAG Golf Inc. and its affiliates, officers, directors, employees and agents from and against any claims, damages, losses and expenses (including reasonable legal fees) arising out of your use of the Site or breach of these Terms of Use.

11. Governing law

These Terms of Use are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising under these terms shall be subject to the exclusive jurisdiction of the courts of Ontario.

12. Changes to these terms

We may update these Terms of Use at any time by posting a revised version on the Site. Continued use of the Site after changes are posted constitutes acceptance of the revised terms. We encourage you to review this page periodically.
